Federal Judge Issues Injunction over DACA

Judge Andrew Hanen issued a preliminary injunction against the expanded version of Deferred Action for Childhood Arrivals (DACA) and the new Deferred Action Parental Accountability (DAPA) program. This action is the most recent in a long line of defenses the Republican politicians in Texas have taken against the immigration programs set up by President Obama.

Reasons for blocking or delaying the implementation of these programs changes rather regularly among the politicians that do not support them, however, a majority of the reasons contain numerous holes and therefore do not sit well with the people of Texas. However, Judge Hanen has publicly spoken against the immigration reform programs and therefore, in the eyes of the Republicans, was the perfect judge to present this case to.

While the ruling by Judge Hanen has suspended program commencement, there is no certainty to the longevity of the outcome of the ruling. Hanen’s ruling can all but surely be said to be political and not judicial, as the reasons stated for the preliminary injunction are inconsistent and unsound. The injunction was not issued based on any findings that the president’s resolution was unconstitutional or illegal. The reason given for rejection of the executive order was an error based on procedure; Hanen issued his stay on the programs based on the slight chance that they may not succeed, and therefore have prevented them from moving forward.

Throughout Hanen’s statements concerning his decision, there are holes in his negative reasoning on the implementation of these programs and many statements he makes regarding illegal immigrants are untrue. For example, declarations that illegal immigrants increase crime rates and cost the educational system more money for each DREAM child that is educated are not consistent with facts or statistics in either area.

Although it is generally understood that the decision made by Judge Hanen will not stand in the long run, the ruling has created an unnecessary delay in a process which has been put in place to help millions of illegal immigrants and their children create stability and recognizance for themselves in the country they have made their home. Once again, the never-ending, unwinnable political tug-of-war has caused an authority to make a decision based solely on the purpose of hindering the ideas of a counterpart rather than on the millions of lives in turmoil throughout the United States.
