80 year-old Sex Offender behind bars despite appeals court decision
Twenty years ago, a man pleaded guilty to two counts of first-degree sexual abuse involving two minors (one of them a relative). For this, he was sentenced to one hundred and twenty days in jails, a twenty year sentence (given in two consecutive ten-year suspended sentences) ordered to register as a sex offender and forbidden to have any unsupervised interaction with children under the age of sixteen. The man was Alton Henry Hice and he was convicted on August 1st, 1995; he was sixty years old.
A suspended sentence is “a sentence given after the formal conviction of a crime that the convicted person is not required to serve”. However, if the convicted felon is successfully charged with another crime during the suspended sentence, the presiding judge must revoke the suspension and have the defendant serve the full sentence time.
This is what happened to Alton Hice. His first suspended sentenced ended in 2005 and the second one would end in 2015. But now, aged eighty, Hice faces an additional ten years in jail following asecond-degree sexual assault charge filed against him in October 2013, to which he pleaded guilty yet again. On the witness stand, both the victim and her mother testified to Hice’s sexual advances on a minor and the latter reportedly also contacted the defendant’s wife who, upon receiving this information, replied with “what do you want me to do about it?”.
On Wednesday, the 18th of February, the Court of Appeals ruled that the two consecutive suspended sentences given in 1995 were illegal, citing Arkansas law which states that multiple suspended sentences must run concurrently.In spite of this, Circuit Court Judge Michael Fitzhugh revoked the second of Hice’s ten-year sentences and the sex offender was given a ten-year sentence in prison along with an additional ten years suspended.
According to the Arkansas Department of Correction, the inmate is eligible to parole on January 4th, 2016.
